Terms of service

Who you are contracting with

The service is operated by Tigran Avakov, trading as Inclusive Forge, Mirzo-Ulugbek 45A, 100007 Tashkent, Uzbekistan. Payments are collected by Paddle.com Market Ltd, who act as the merchant of record and appear as the seller on your receipt and card statement.

What the service does

It scans the buying path of a storefront you have proved you own, reports what it finds against WCAG 2.1 AA and the matching clauses of EN 301 549, suggests the change to make, and records findings and fixes in an append-only journal.

What a finding is, and what it is not

A finding is the result of a deterministic rule applied to your page at a moment in time. It is not legal advice, not a determination that you are in breach of anything, and not a certificate.

An automated scan detects part of what the standard requires. The rest needs a person, and we say so in every report rather than letting the number speak for itself.

We do not represent you before any authority, we do not correspond with a supervisor on your behalf, and the legal obligation stays with you.

What you are responsible for

• Proving you own or are authorised to audit any storefront you add.
• Making the changes. We tell you what to change; the change is yours to make and to test.
• Reviewing anything we generate, including the accessibility statement, before you publish it.

Billing

Plans are monthly with no annual commitment. Your plan changes when your payment provider tells us it changed, and the price you see at checkout is the price you pay.

There is no cancel button inside the product. Being able to press one would require us to hold a key that can act on your subscription, and we would rather not hold a key that powerful for a button an email replaces. Write to support@inclusiveforge.com and it is done the same day.

Acceptable use

• Do not point the scanner at a storefront that is not yours.
• Do not use the service to build a competing dataset of other shops.
• Do not present our report as a certification, ours or anyone else’s.

Disclaimers and liability

The service is provided as is. We do not warrant that it finds every barrier, because no automated tool does, and we say which portion it finds rather than implying it finds all of them.

Our total liability for any claim will not exceed what you paid us in the twelve months before the claim.

Ending it

You can stop at any time by email. We can end the agreement if you use the service against a storefront that is not yours, and we will say why.

Your journal export stays available for thirty days after the account closes, because it is the part you may need later.

Governing law

These terms are governed by the laws of the Republic of Uzbekistan, without regard to conflict-of-law principles.
